Real Estate Practice Overview

Our real estate practice serves a wide range of clients, including residential buyers and sellers, land developers, builders, landlords, tenants and other commercial interests.   Our attorneys represent clients in all proceedings and transactions that deal with real property, including: Residential Real Estate Closings Mortgage Refinancing Zoning and Land Use Landlord/Tenant Relations, and  Commercial Real Estate Transactions

Residential Real Estate Closings

A large portion of our real estate practice is devoted to representing residential buyers and sellers in new construction and existing homes. Our attorneys personally work with clients reviewing the contract, mortgage issues, home inspection issues and other various issues that regularly arise and make sure that your rights are protected and your expectations are fulfilled. We are experienced in negotiating home inspection issues, correcting title problems, and addressing other issues that may develop in your transaction.  Additionally, we have a knowledgeable and experienced staff to assist in the processing of your transaction to ensure that it goes smoothly with no surprises. Whether you are buying new construction, selling a condominium, or selling an historic home with character, our firm can provide you the technical competence you require so as to reduce the emotional element of the real estate transactions.

Mortgage Refinancing

Many homeowners will refinance their mortgage at some point in time during their ownership.  Mortgage refinancing may provide many benefits to a homeowner such as reducing their interest rate and monthly payment or allowing the homeowner to pull additional equity out of their home.  We can assist you in all aspects of your mortgage refinancing needs.

Zoning and Land Use

Your municipal government has the ability to control what you may do with your property through land use ordinances.   The ordinances may be different for particular zones within your community.  In theory, all properties within a particular zone are supposed to be treated equally, however, in practice all real estate is unique and variances from the ordinances may need to be granted on a case by case basis.  The land use ordinances also provide the manner in which you may subdivide your lot if it is of sufficient size.  Our firm is capable of handling all of your land use needs from a simple bulk variance to permit the construction of a sun room off the rear of your house to the more complex such as subdivision of your property or a site plan application for a particular use of your commercial property.

Landlord/Tenant Relations

Our real estate practice also concentrates on all aspects of landlord tenant relations.   We regularly prepare and negotiate residential and commercial leases on behalf of both tenants and landlords.  Both landlords and tenants have legal duties and obligations which are expressed in leases or implied through common law and statutes.  Thus, the drafting and review of a lease is critical to protecting your interests.  We have the knowledge and expertise to represent you in a dispute whether you are landlord or tenant.

Commercial Real Estate

If you are purchasing or selling a commercial property such as an office buildings, shopping center, warehouse, manufacturing facility, apartment complex there are special issues to consider.   You need to be aware of potential environmental contamination issues.  If the building or the surrounding land has been contaminated by hazardous substances, you could face a very expensive clean-up mandated by state and federal laws. Our firm can guide you through the process of obtaining the necessary clearances so that you can protect yourself from unnecessary clean up costs.  If the property has existing tenants, your ownership will be subject the leases in place.  You will be bound by the terms in the existing leases.  We can assist you in reviewing the leases and identifying potential problems down the road.  If you have a need to utilize the property in a particular manner, we can guide you through the process to ensure that you will be able to use the property as intended, and also represent your interests before any municipal boards if approvals are required.
